Boy, we’ve seen this before. From the Associated Press:
OKLAHOMA CITY — Gov. Brad Henry has granted clemency to Kevin Young, sparing him from execution. Young, 43, was scheduled to die Aug. 21 for the May 1996 killing of 56-year-old Joseph Sutton at a gambling room inside a northeast Oklahoma City steakhouse.
Henry commuted Young’s death sentence Thursday to life in prison without the possibility of parole/ During the clemency hearing, an apologetic Young told parole board members he has become a Christian.

This case is troubling from both sides. On the one hand, nobody in Oklahoma, when electing a governor or an AG thinks that they are also voting on a referendum on validly enacted laws like the death penalty. Neither the Gov. nor the AG should have the right to simply overturn the will of the people and the decision of a jury in matters like this.
But, on the other, executive clemency does serve a valid purpose. As time passes, more information becomes available and it is always possible that it looks like a mistake was made. In cases like this, it may not be possible to overturn the conviction but conscience and common sense make commutation a rational decision. John Grisham did a great job of educating us all on how badly capital cases can be handled in Oklahoma and how a completely innocent man can wind up on death row.
The problem here is that Henry is not citing any of those reasons. We know that the man committed the murder in the process of committing a felony, armed robbery. And we know that he shot back after he was shot at. But, had he not been committing the felony in the first place nobody would have died that night. Classic felony murder.
Like most of Henry’s decisions, we don’t know how or why he decided to commute. And consequently he has let both sides of the argument down.
